ORDINANCE 684

STONYCREEK TOWNSHIP, CAMBRIA COUNTY

AN ORDINANCE OF THE TOWNSHIP OF STONYCREEK, COUNTY OF CAMBRIA, COMMONWEALTH OF PENNSYLVANIA, AMENDING  ORDINANCE 192 , WHICH WAS DULY ADOPTED, AMENDED AND RESTATED, MARCH 8TH 1988,THE STONYCREEK TOWNSHIP POLICE PENSION PLAN , BY PROVIDING FOR THE PURCHASE OF SERVICE BASED PENSION PLAN CREDIT

WHEREAS, Senate Bill 464 was signed into law as Act 49 on July 8, 2024, which among other things, permits the governing body of municipalities and regional police departments to amend their police pension plan to allow officers, who are vested in their current plan, the option to purchase prior part-time or full-time police service to be credited to pension service purposes; and

WHEREAS, on July 8, 2025 the Stonycreek Township Board of Commissioners enacted Ordinance 684 that amended Ordinance 192 to allow officers, who are vested in their current plan, the option to purchase prior part-time or full-time police service to be credited for pension service purposes in accordance with Act 49 of 2024; and

NOW, THEREFORE, the Township of Stonycreek amends Ordinance 192 to permitting the Pension Plan and its qualified investment manager to develop language, terms and conditions and other requirements  to authorize a qualified officer to purchase and receive pension service credit, as consistent with Act 29 and Act 600.

ORDAINED AND ENACTED by the Board of Commissioner of Stonycreek Township, Cambria County and Commonwealth of Pennsylvania, meeting in public session, this 8th day of July, 2025

RESOLUTION 2025-04

Amending Resolution 2025-03

Be it RESOLVED, that the Township of Stonycreek Township, Cambria County hereby request a Multimodal Transportation fund Grant of $821,687.00 from the Commonwealth Financing Authority to be used for the Stonycreek Township Cambria County Wildwood Avenue Road Project

Be it FURTHER RESOLVED, that the Applicant does hereby designate, Douglas Sedlemeyer, President Board of

Commissioners as the official to execute all documents and agreements between the Township of Stonycreek and the Commonwealth Financing Authority to facilitate and assist in obtaining the requested grant.

I, Jennifer D Wagner, duly qualified Township Administrator of the Township of Stonycreek Cambria County, PA hereby certify that the forgoing is a true and correct copy of a Resolution duly adopted by a majority vote of the Township of Stonycreek to be presented at the regular meeting held July 8, 2025 and said Resolution has been recorded in the Minutes of the Township of Stonycreek and remains in effect as of this date.

STONYCREEK TOWNSHIP

FORMAL RECORD OF ACTION

Amending Resolution 2021-6

The following is a formal record of action taken by the governing body of STONYCREEK TOWNSHIP  (the "Employer").

 

With respect to the amendment of the STONYCREEK TOWNSHIP 457 PLAN (the "Plan"), the following resolutions are hereby adopted:

 

RESOLVED: That the Plan be amended in the form attached hereto, which amendment is hereby adopted and approved;

 

RESOLVED FURTHER: That the appropriate officers of the Employer be, and they hereby are, authorized and directed to execute said amendment on behalf of the Employer;

 

RESOLVED FURTHER: That the officers of the Employer be, and they hereby are, authorized and directed to take any and all actions and execute and deliver such documents as they may deem necessary, appropriate or convenient to affect the foregoing resolutions including, without limitation, causing to be prepared and filed such reports, documents or other information as may be required under applicable law.

              RESOLUTION 2025-6 

     STONYCREEK TOWNSHIP 457

 PLAN 2012 REQUIRED  AMENDMENT

WHEREAS, STONYCREEK TOWNSHIP (the "Company")  maintains the STONYCREEK TOWNSHIP 457 PLAN (the "Plan") for the benefit of certain of its employees; and

 

WHEREAS, Pursuant to applicable IRS procedures, the Company desires to amend the

Plan;

NOW, THEREFORE, the Plan is hereby amended as set forth below effective as provided therein.

 This Amendment to the Plan is adopted to reflect provisions of the Worker, Retiree and Employer Recovery Act (the "WRERA") and certain other provisions of applicable law and the applicable regulations that are generally effective after December 31, 2008 ("Applicable Law").  This Amendment is intended as good faith compliance with the requirements of the WRERA and Applicable Law and is to be construed in accordance with same. This Amendment and the provisions of Applicable Law shall supersede the provisions of the Plan to the extent those provisions  are inconsistent  with the provisions  of this Amendment,  WRERA and Applicable Law.
